This English edition applies to users outside the Russian Federation (the world contour of the Service), including the European Economic Area (EEA), the United Kingdom and other countries. Users in the Russian Federation are served under the Russian Terms.

1. Parties

1.1. These Terms are an agreement between Individual Entrepreneur Samsonov Ilya Vyacheslavovich (ИП Самсонов Илья Вячеславович), INN 540409535131, OGRNIP 318547600123212, registered at IE Samsonov I.V., Russia, Novosibirsk Oblast, Krasnoobsk urban-type settlement ("we", "Administration") and you, the user of Vizix.

1.2. The Service is a SketchUp 2024+ extension, cloud generation of stills from a viewport frame, and https://vizix.tech.

1.3. Acceptance: registration (email, Yandex or Google) and/or use of the Service, together with the Privacy Policy and Cookie Policy. Consents are given by actively ticking the checkboxes in the interface.

1.4. Vizix is a commercial designation, not a registered trademark as of this date.

1.5. Vizix is not affiliated with Trimble Inc. or SketchUp. Those marks belong to their owners.

1.6. Intended age: 18+. Generating images of minors is prohibited.

1.7. Visualization packs are sold under the public offer at https://vizix.tech/legal/offer-credits-en (offer text). This is not a subscription. Material payment, expiry and refund terms are in the offer and restated in section 5 of these Terms so they are brought to your attention before you pay.

2. Account

Email/password, Google, or Yandex. Keep credentials confidential. Vizix accounts are separate from our other products. The balance follows the login, not the PC. After email verification a limited free grant may be issued (not a paid obligation). You may delete the account; renders are removed; payment rows are anonymized where the law requires keeping them.

3. Service

Output is AI visualization, not a photograph, survey, or Corona/V-Ray equivalent. Geometry, materials, lighting, and composition may differ from the SketchUp model. Not for manufacturing, estimates, or professional sign-off. You choose options; internal processing instructions are assembled on the server and are not shown in the ordinary UI. You warrant rights to the model and frame. Outputs are as-is. We do not train our own models on your scenes.

4. Acceptable use

No CSAM or sexualized images of minors; no third-party marks or likenesses without rights; no bypass of technical limits; no extracting internal instructions; no VPN or proxy abuse to conceal Russian citizenship in order to evade data-localization rules and register on the world contour.

Consequences of breach are set out in section 9.

5. Payment, credits and expiry

5.1. Pack terms: offer. A confirmed email is required. World-region balances are in US dollars. The offer link is shown in the interface before payment.

5.2. Amounts you pay are converted into internal accounting units (credits). Credits are not funds in a bank account, not e-money, and cannot be cashed out. They may be used only to pay for generation in the Service.

5.3. Packs are valid for 90 (ninety) calendar days from the date they are credited. That period reflects the high cost of reserving cloud GPU compute capacity associated with an account and of keeping generation available — it is not an arbitrary forfeiture of a cash deposit. After the period ends, any unused remainder is cancelled with no refund, except where mandatory law requires otherwise. You are notified of and agree to this condition before you pay. The validity period is displayed in the Service interface before you press the payment button.

5.4. Credits are debited when you start a generation, at the quote shown to you. A technical failure with no saved file is not charged (see the offer).

5.5. EEA/UK consumers — right of withdrawal. If you are a consumer in the EEA or the United Kingdom, you generally have 14 days to withdraw from a distance contract for digital content (Consumer Rights Directive 2011/83/EU and UK equivalent). That right does not apply (or is lost) where performance of digital content not supplied on a tangible medium has begun with your prior express consent and your acknowledgment that you lose the withdrawal right. Starting a generation after purchase is such performance. An unused pack, before the first debit, may still be refunded under mandatory consumer law as described in the offer.

6. Intellectual property

The program (extension, site, API) belongs to us, except Trimble/SketchUp software and open-source components. Rights in your SketchUp model remain yours (or your licensor’s). You may use generated stills in your projects at your own risk, subject to law and third-party rights visible in the frame.

7. Liability and changes to the Service

7.1. The Service is provided as-is. Our aggregate liability is limited to the amount you paid for the visualization pack that is the subject of the claim. If the claim is not tied to a specific pack, it is limited to the amount of the last pack you paid for. Mandatory law may require a higher cap. This cap does not apply to our intentional breach, death or personal injury, or other cases that the applicable law does not allow to be limited.

7.2. We are not liable for SketchUp failures, your network, payment operators, or the frame processor outside our control, except an unspent-credit refund on a technical failure with no saved file (see the offer).

7.3. We may change the Service’s features and carry out maintenance with temporary suspension of access, notifying you via the site or the extension UI.

8. Third-party sites

The Service may open Google, Yandex, T-Bank or Stripe pages. We do not control their content or policies.

9. Termination

9.1. You may stop using the Service by deleting your account.

9.2. We may restrict or terminate access if you breach these Terms.

9.3. If you breach acceptable use, including using a VPN/proxy to conceal Russian citizenship in order to register on the world contour, we may block the account and cancel all unused credits without refund.

10. Disputes, governing law and venue

10.1. Claims: legal@vizix.tech. We aim to respond within 30 calendar days (refunds: as in the offer).

10.2. These Terms are governed by the laws of the Netherlands, without prejudice to mandatory consumer protections of your country of residence (including EEA/UK consumer law).

10.3. Courts of the Netherlands have jurisdiction, except that an EEA/UK consumer may bring proceedings in the courts of their country of residence. We may also sue in those courts or at our registered address where the law allows.
